הקליניקה לזכויות אדם בינ"ל ארגנה והשתתפה באירוע צד ב 5.7.23 שהתקיים בג'נבה במועצת זכויות האדם של האו"ם (אירוע המתקיים בזמן מושב של המועצה) שדן בארבעת הנעדרים המוחזקים על ידי החמאס בעזה כתשע שנים, אברה מנגיסטו והישאם אל סיד (שני אזרחים בעלי מוגבלויות) והדר גולדין ואורון שאול (שני חיילים שנפצעו במהלך מבצע חומת מגן, הוכרזו כמתים וגופותיהם מוחזקות ע"י החמאס).

 

במהלך האירוע בהנחיית פרופ' יובל שני, סיפרו בני משפחותיהם על הסבל שהם חווים וקראו להשבת הבנים, עו"ד דנה יפה הציגה את הפעילות של הקליניקה לזכויות אדם בינ"ל בעניינם, והתקיים דיון אודות הדין הבינ"ל בהקשרם, בהשתתפות פרופ׳ גרז׳ינה ברנובסקה (מקבוצת המומחים של האו״ם המטפלת בהיעלמויות כפויות) ופרופ׳ מרקו ססולי (מאוניברסיטת ג׳נבה), הכל בתקווה להוביל לסיוע מצד גורמים בינלאומיים שיקדם את שחרורם של הנעדרים. ניתן לצפות באירוע בקישור הזה.

 

מעבר לאירוע, במסגרת הביקור שאורגן על ידי המשלחת של ישראל במועצה נפגשה המשלחת, בין היתר, עם נציב זכויות האדם של האו"ם, סגן נשיאת ארגון הצלב האדום, שגרירת ארה"ב למועצה לזכויות האדם ועוד.

The International Human Rights Clinic was among the organizers of a side event that took place on July 5th 2023 during a session of the UN Human Rights Council in Geneva. The event focused on the fate of the four Israelis, who have been held as hostages by HAMAS in Gaza Strip for over nine years: Avera Mengistu and Hisham al-SAyed (two civilians who suffer from severe mental disabilities) and Hadar Goldin and Oron Shaul (two IDF soldiers who were captured during operation 'Protective Edge’ and declared dead by the IDF. Their remains are held by HAMAS).

 

In the event, moderated by Prof. Yuval Shany, family members of the four hostages conveyed the suffering they experience and called for the safe return of their loved ones; Adv. Dana Yaffe presented the Clinic's legal activities on their behalf before UN Human Rights Bodies;  The event concluded with a discussion on the International Human Rights Law framework with Prof. Ms. Grażyna Baranowska, a member of the Working Group on Enforced and Involuntary Disappearances, and Prof. Marco Sassoli from the University of Geneva. The event was aimed to encourage a greater degree of intervention on the part of the international community in order to facilitate the fast return of the four hostages to their families. During their visit, organized by Mission of Israel to the UN in Geneva, the families met, among others, the UN High Commissioner for Human Rights, the vice president of the International Committee of the Red Cross, the US ambassador to the Human Rights Council and more.
